CLARIFICATION APG: EU Court: EU Agency ACER May Amend Joint Proposals of Transmission System Operators

The background to the decision was not a purely Austrian issue, but rather the question of the decision-making competence for setting the framework conditions for the establishment and implementation of European platforms for balancing energy ("balancing platforms"). In 2020, APG, together with seven other European transmission system operators (TSOs), had contested the decision of the EU regulatory agency ACER, which had overruled a joint proposal of the TSOs. The subject of the European Court's decision was thus an issue of institutional competence. Together with its TSO partners, APG will analyze the content of the decision and its possible consequences in detail and then decide on the further course of action.
